INTRODUCTION: This case involves the suspect being arrested for H&S 11377(a)Possession of Methamphetamine, H&S 11364(a)-Possession of drug paraphernalia and PC 148(a)(1)-Resisting/Delaying a Peace Officer. LOCATION DESCRIPTION: This incident occurred inside 848 Summit Avenue #1. The location is a rear duplex to the rear of a long east-west driveway running along the north side of 844 Summit Avenue, which faces the street.
EVIDENCE: Items Description 1) Methamphetamine, approximately 6.08 grams of a white crystal substance resembling methamphetamine, which was packaged in two plastic baggies. Found in Suspect Castaneda’s gym bag. 2) Marijuana, approximately 6.48 grams of a green leafy substance resembling marijuana, which was packaged in a plastic baggie and a green plastic container. Found in Suspect Castaneda’s gym bag. 3) Black digital scale. 4) Glass pipe approximately 3 inches in length with a bulb at the end. Found in Suspect Castaneda’s gym bag. 5) Black eye glass case; containing Q-tips.
6) Green plastic container. 7) (3) plastic baggies, which contained Methamphetamine. 8) Yellow marijuana grinder. 9) Knife, 6 inches in length, in a brown sleeve. 10) Nokia cell phone, which belongs to Suspect Castaneda. INVESTIGATION: On 01-13-16 at 1235 hours, Officer Cass #2067 and I were dispatched to Huntington Memorial Hospital (HMH) East Tower, Room #626 regarding a PC 243(a)-Battery investigation (refer to X/R case #16000621 for additional information.)
After obtaining the victim’s statement, Officer Cass and I drove to 848 Summit Avenue #1, to determine if the residence was locked and secured. Upon our arrival, I saw that the front living room window was broken as if someone entered the residence to commit a burglary. I then heard voices and music coming from inside of the residence. I saw that the south side door was wide open. I believed that a burglary or a possible trespassing was occurring, knowing that Boyd told us no one was supposed to be inside of the residence. Officer Cass and I had probably cause to enter the residence. We entered through the south door and immediately saw a male Hispanic sitting on a chair inside of the kitchen, later identified as Suspect Edgar Castaneda.
Castaneda had his back toward the side door as we made entry. I saw a gym bag on the floor directly in front of Castaneda. We also saw two female Blacks in the kitchen, later identified as June Lofton (DOB of 11-14-86) and Stephanie Price ((((()))))). I detained the individuals, while Officer Cass cleared the residence. While detaining the above individuals, I saw that Officer Cass had handcuffed and detained a male Black, later identified as Joshua Collins. The two females walked into the living room and Suspect Castaneda remained seated. Based on Officer Cass detaining Collins, I asked Castaneda to place his hands behind his back to be handcuffed pending further investigation Castaneda stated, “You don’t have a reason to detained me.” and refused to follow my instructions.
I advised Castaneda he was only being detained and not arrested. Castaneda said, “I’m not putting my hands behind my back, you have no reason to detained me.” I asked Castaneda two additional times to place his hands behind his back. Castaneda said, “I’m not doing it. Do what you have to do.” Castaneda then began talking on his cellular telephone. I took hold of Castaneda’s right bicep with my right hand and placed my left hand onto his right shoulder. I told him to place his right arm behind his back as I began to pull his right arm back.
Castaneda then pulled his right arm forward, attempting to pull free from me and he began to stand up from the chair. Based on Castaneda’s above actions, I pulled his right arm behind his back and pushed him forward onto the kitchen floor with my left hand and body weight. I placed my right leg across Castaneda’s upper back and handcuffed his right wrist. Officer Cass entered the kitchen and assisted me with handcuffing Castaneda. The handcuffs were double locked. I saw that Castaneda’s wristwatch glass face had shattered during the incident. The pieces of glass caused approximately two pin size scratches on his back. I assisted Castaneda up from the floor and walked him out of the residence. I saw that Castaneda had two scratches on the top of his forehead.
The first scratch was approximately an inch long and the second was about half an inch long. I then noticed that I was bleeding from the top of my right hand, just below my right index finger.. sustained two pin sized cuts from the watches shattered glass. Officer Cass walked out the front door with the gym bag and asked Castaneda if it belonged to him. Castaneda said, “Yes, it’s my bag.” Incident to arrest, I searched the gym bag. I found a black eye glass case which contained; two plastic baggies, a glass pipe and Q-tips. The plastic baggies contained methamphetamine. I also found a plastic baggie and a green plastic container which both contained marijuana. The gym bag also contained a black scale, a yellow marijuana grinder and a knife.
The knife was in a brown sleeve. Based on my training and experience, I determined the white substance to be crystal methamphetamine and the glass pipe recovered is commonly used to smoke methamphetamine. Sergeant Beene # approved the arrest. I collected the above items as evidence. I arrested Castaneda for H&S 11377 (a)-Possession of Methamphetamine, H&S 11364(a)-Possession of drug Paraphernalia and PC 148(a)(1)-Resisting/Delaying a peace officer. Officer Cass and I transported Castaneda to the Pasadena Jail for booking.
Castaneda was later issued a citation for H&S 11377 (a)-Possession of a controlled substance, H&S 11364(a) Possession of drug Paraphernalia, PC 148(a)(1)Resisting/Delaying and H&S 11357(b)-Possession of Marijuana less than one ounce (Citation #C27291). Castaneda is scheduled to appear at the Pasadena Court on 04-12-16 at 0830 hours. ID Tech Schmidt #responded to the jail and took photos of Castaneda’s injuries. I took a photo of the injury to my right hand. The above photos were later uploaded into VeriPic. I conducted a Wells Test on the methamphetamine which tested positive. I booked the above items into evidence (Items 1-10). DISPOSITION: Case to Detectives.
